This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the domain name https://www.aquaproduct.in/ ("Website"), including the related mobile site and mobile application (hereinafter referred to as the "Platform").

1. Ownership of the Platform

The Platform is owned and operated by AQUA PRODUCT (Bareezé Pure), managed by Mohammed Arqam Hasan Ghazali Shamsi, having its registered place of business at:

(hereinafter referred to as "Platform Owner", "we", "us", or "our").

By accessing, browsing, or using the Platform, or by placing an order, you ("you", "your", "user", or "customer") agree to be bound by these Terms of Use, together with all policies referenced herein, including our Return & Refund Policy, Shipping Policy and Privacy Policy. If you do not agree, please do not use the Platform.

2. About Our Products

1. AquaProduct.in sells water purifier spare parts, filter kits, PCBs, SMPS adapters, motors/pumps, taps, membranes and related accessories under our own brands, including Bareezé Pure.
2. Many of our products are compatible / aftermarket spare parts. Brand names such as Aquaguard, Kent, Livpure, Pureit, AO Smith, Whirlpool, Havells and others are used only to indicate compatibility of the part with the respective purifier model. We are not affiliated with, endorsed by, or authorised dealers of these brands unless expressly stated. All trademarks belong to their respective owners.
3. Product images are for representation. Minor variations in colour, packaging or appearance may occur without affecting fitment or function.
4. It is your responsibility to confirm the correct part for your water purifier model before ordering. Our team is available on phone/WhatsApp +91 7045222111 and email aquaproducts920@gmail.com to help you choose the right part. We confirm every order before dispatch.

3. Use of the Platform

1. To access and use our Services, you agree to provide true, accurate and complete information during and after registration or checkout, and you are responsible for all acts done through your registered account, phone number or email on the Platform.
2. You agree not to use the Platform for any purpose that is unlawful, illegal or forbidden by these Terms or by Indian or local laws applicable to you.
3. Unauthorised use of the Platform or its content may lead to action against you under these Terms and/or applicable laws.

4. Pricing, Payments and Orders

1. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Shipping charges (if any) and discounts are calculated at checkout.
2. We accept prepaid payments (UPI, cards, net banking, wallets) and Cash on Delivery (COD) on eligible orders across India.
3. Promotional offers and discount codes (for example, prepaid-order discounts) may be modified or withdrawn at any time without notice.
4. Upon initiating a transaction, you are entering into a legally binding and enforceable contract with the Platform Owner for the purchase of products.
5. We reserve the right to cancel any order in cases of pricing errors, stock unavailability, suspected fraud, or inability to verify order details. In such cases, any amount paid will be refunded to the original payment method.

5. Shipping and Delivery

1. We ship across India through third-party courier partners. Estimated delivery timelines shown at checkout or communicated to you are indicative and not guaranteed.
2. Order tracking details are shared after dispatch. Please refer to our Shipping Policy for full details.
3. Please record a clear unboxing video while opening your parcel. This is mandatory for any damage, defect or wrong-product claim, as detailed in our Return & Refund Policy.

6. Warranty

Warranty on applicable products is as follows:

1. Warranty covers manufacturing defects only. It does not cover physical damage, burn damage due to voltage fluctuation, water ingress into electrical parts, improper installation, tampering or normal wear and tear.
2. Consumable items (filters, membranes, candles, sediment/carbon cartridges, etc.) are wear-and-tear items and carry no warranty unless expressly stated on the product page.

7. Returns and Refunds

All sales are governed by our Return & Refund Policy, published on this Platform. In summary: all products are non-refundable; genuine damaged/defective/wrong-item cases are resolved by replacement, subject to the mandatory unboxing video and the conditions stated in that policy. Please read the Return & Refund Policy carefully before ordering.

8. Disclaimer

1. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this Website or through the Services for any specific purpose. Such information may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
2. Your use of the Platform and Services is entirely at your own risk and discretion. You are required to independently assess and ensure that the products and Services meet your requirements.
3. Installation of spare parts should be done by a trained technician or by carefully following our tutorial guidance. We are not responsible for damage caused by incorrect installation.

9. Intellectual Property

The contents of the Platform — including but not limited to the design, layout, look, graphics, text, product photographs, videos and logos of Aqua Product / Bareezé Pure — are proprietary to us or licensed to us. You may not copy, reproduce or use them without our prior written permission.

10. Third-Party Links

The Website and Services may contain links to third-party websites (for example, courier tracking, social media, payment gateways). On accessing such links, you will be governed by the terms of use and privacy policies of those third-party websites. These links are provided for your convenience only.

11. Indemnity

You shall indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers, agents and employees from any claim, demand or action, including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms of Use, the Privacy Policy or other policies, or your violation of any law, rules, regulations or the rights (including intellectual property rights) of a third party.

12. Force Majeure

Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event (including natural calamities, strikes, lockdowns, courier disruptions, or government restrictions).

13. Modification of Terms

These Terms of Use may be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms, and any dispute or claim relating to them or their enforceability, shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
